1. What Ask The Recruiter does
AskTheRecruiter.com ("AskTheRecruiter," "the Service," "we," "us") is a resume tailoring and career preparation tool. You provide your resume and a job description; we use AI to analyze the match, generate a tailored resume draft, write a cover letter, and prepare interview coaching. The Service is based in Wyoming, United States, and is offered to users globally. We voluntarily apply EU GDPR / UK-GDPR, California CCPA/CPRA, Quebec Law 25, Brazil LGPD, and other international consumer-protection and data-privacy frameworks to all users — not just users physically located in those jurisdictions.
2. Accepting these terms
By using Ask The Recruiter, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We may update these terms; continued use after updates constitutes acceptance.
3. AI-generated content — important disclaimers
Results are AI-generated. All resume drafts, cover letters, interview preparation materials, and analysis outputs are generated by artificial intelligence. While we design our system to ground every suggestion in your actual resume experience, AI can make mistakes.
You are responsible for reviewing all output before use. Do not submit any AI-generated resume, cover letter, or other document to an employer without reading it carefully and verifying that every claim is accurate and truthful.
We do not guarantee employment outcomes. Ask The Recruiter is a tool to help you present your existing experience more effectively. We do not guarantee that using the Service will result in interviews, job offers, or any specific outcome.
We do not provide career advice, legal advice, or professional consulting. The Service generates documents and analysis based on pattern matching between your resume and a job description. It is not a substitute for professional career coaching, legal counsel, or human judgment.
4. Your account
Creating an account. You may use limited features without an account. To access all features, you must create an account using a valid email address. We use passwordless magic-link authentication.
Account security. You are responsible for maintaining access to the email address associated with your account. If you believe your account has been compromised, contact our in-app contact form (https://asktherecruiter.com/contact) immediately.
One account per person. Each account is for individual use. Sharing accounts or creating multiple accounts to circumvent usage limits is not permitted.
Account communications (transactional). When you create an account, purchase a credit pack, or take security-relevant actions (sign-in, account deletion request, sub-processor change notification), we send you transactional emails. These emails are necessary to provide the Service and you cannot opt out of them while your account is active. Transactional email is delivered by Resend (magic links, security notifications, account-deletion confirmations) and by Stripe (purchase receipts — see §5). Recipient address only is shared with these providers; no resume content, job-description content, or generated drafts is ever included.
Optional product-updates newsletter. At signup and from your /account page you may opt in to an occasional product-updates newsletter delivered by Mailjet by Sinch (an EU-based, France-headquartered email-list provider). This opt-in is separate from your acceptance of these Terms — it is unchecked by default, and signup succeeds whether you tick it or not. Only your email address is sent to Mailjet, and only if you actively opt in. All subscribers — regardless of jurisdiction — receive a double-opt-in confirmation email and are added to the list only after clicking the confirmation link, per GDPR Art 7(1) and DE-TTDSG §13 (we apply the stricter EU/UK/DE standard universally). 5. Credit packs and payment
Credit packs. Ask The Recruiter uses a pay-as-you-go credit system. You purchase credit packs at the prices listed on our pricing page. Each feature use (resume tailoring, detailed edit, cover letter, or interview prep) costs one credit.
Free credits. New users receive 4 free credits on signup. Free credits cannot be transferred or exchanged for cash.
One-time purchases. Credit packs are one-time purchases, not subscriptions. There is no auto-renewal. You will never be charged again unless you actively purchase another credit pack.
Credit expiration. Credits expire 30 days after purchase. Unused credits are forfeited after the 30-day window. No extensions are granted. Credits are also forfeited immediately if your account is deleted before the 30-day expiry.
No refunds on used credits. Once a credit has been consumed by generating a result, it cannot be refunded. If a technical error prevents you from receiving a result after a credit was deducted, contact our in-app contact form (https://asktherecruiter.com/contact) and we will restore the credit.
Refunds — unused packs (statutory right). If you have purchased a credit pack and have not used any credits from that pack, you may request a full refund within 14 days of purchase via our in-app contact form (https://asktherecruiter.com/contact). For EU / EEA / UK consumers this implements your statutory 14-day right of withdrawal under the EU Consumer Rights Directive (Directive 2011/83/EU, Article 9) and equivalent UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — this is a non-waivable statutory right and is not affected by any other clause of these Terms. We voluntarily extend the same 14-day window to all users globally as a matter of policy, but the underlying EU/UK statutory right is preserved verbatim for consumers in those jurisdictions.
Refunds — dissatisfied customers (goodwill policy). If you have used credits but are not satisfied with the results, use the in-app contact form (https://asktherecruiter.com/contact) within 14 days of purchase. We review these requests individually and offer refunds at our discretion. We want you to get value from the service. Refunds are not available on credits that have already expired.
Refund abuse — repeated goodwill claims. Goodwill refunds are not a substitute for the service. We reserve the right to decline goodwill refunds and/or close an account where the same individual (identified across accounts via Stripe customer fingerprint, billing address, signup device, or other reasonable signals) has repeatedly purchased + consumed credits + requested a goodwill refund. The 14-day statutory unused-pack refund window is unaffected; this clause governs the discretionary goodwill window only.
Free credits and promotional packs are not eligible for refunds. Refund eligibility applies only to paid purchases. Free signup credits, promotional credits, and any other zero-cost credit grants cannot be refunded because no payment was made — there is nothing to refund. Asking for a refund on a free pack will return a clear ineligibility response from our admin tools rather than processing.
Pricing changes. We may change credit pack prices at any time. Price changes do not affect credits you have already purchased.
Taxes and surcharges. Prices shown on the pricing page are exclusive of applicable sales, use, value-added, goods-and-services, or similar taxes. Where required by law, Stripe automatically calculates and adds the applicable tax to your purchase at checkout based on the jurisdiction of your billing address. As of the effective date of these Terms, automated tax collection is enabled for United States buyers (Stripe Tax registration in Wyoming, with destination-based US state tax applied per Stripe's tax engine); buyers outside the United States are not currently charged tax by us, though local import or VAT obligations remain your responsibility. The total tax amount, when charged, is itemised on your Stripe receipt.
Payment processing. All payments are processed by Stripe. By making a purchase, you also agree to Stripe's terms of service. We never see or store your full credit card details.
Receipts. Stripe sends an automatic email receipt to the address associated with your account when a credit pack purchase succeeds. The receipt is sent by Stripe directly and includes the purchase amount, any tax collected, the pack you bought, and a link to view the invoice in Stripe's customer portal. If you do not receive a receipt within 15 minutes of a successful purchase, check your spam folder before contacting our in-app contact form (https://asktherecruiter.com/contact).
6. What you can and cannot do
You may:
- Use the Service for your own personal job search
- Edit, modify, and use any output the Service generates for you
- Download and share your generated documents
- Use the Service on behalf of someone else with their explicit consent (e.g., helping a family member tailor their resume)
You may not:
- Use the Service to generate fraudulent resumes or fabricate experience you do not have
- Reverse-engineer, scrape, or systematically extract data from the Service
- Use automated scripts, bots, or tools to access the Service (other than your normal web browser)
- Resell access to the Service or its outputs commercially (e.g., running a resume-writing business powered by Ask The Recruiter)
- Upload malicious content, attempt to exploit vulnerabilities, or interfere with the Service's operation
- Create accounts using disposable or temporary email services to circumvent free credit limits
- Use the Service in any way that violates applicable law
7. Your content
You own your content. Your resume text, job descriptions, and any edits you make remain your property. We do not claim ownership of any content you provide.
License to process. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering the Service (analyzing your resume, generating outputs, and storing results in your account). This license terminates when you delete your account or your data.
No training on your data. We do not use your resume text or any personal content to train AI models. Our AI provider agreements prohibit using customer API data for model training.
8. Intellectual property
Our Service. The Ask The Recruiter name, logo, website design, prompts, algorithms, and software are our intellectual property. You may not copy, modify, or distribute any part of the Service without our written permission.
Your output. The tailored resumes, cover letters, and interview prep materials generated for you are yours to use freely. We do not claim any intellectual property rights over your generated output.
9. Data handling and privacy
Our handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:
- We never sell your data
- We never share your data with advertisers
- Resume text is never written to application logs
- You can export or delete all your data at any time
- AI providers process your text under commercial API agreements that prohibit training on customer data
10. Service availability and limitations
No uptime guarantee. We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Rate limiting. To ensure fair access and manage costs, we apply rate limits (currently 10 AI processing requests per minute per user). Exceeding rate limits may result in temporary throttling.
AI model changes. We may change the underlying AI models used by the Service at any time to improve quality or manage costs. We will not materially reduce the quality of the Service without notice.
Payment + receipt delivery monitoring. Payment processing depends on Stripe webhooks and on Stripe's automatic receipt email service. We monitor both for failure and operate an internal alerting + on-call runbook so that, if a webhook fails or a receipt is delayed, credits you paid for are still granted to your account (the webhook is the source of truth for credit delivery, not the receipt email). If a credit pack purchase succeeds in Stripe but credits do not appear in your account within 5 minutes, contact our in-app contact form (https://asktherecruiter.com/contact) and we will reconcile manually.
11. Limitation of liability
To the maximum extent permitted by law:
The Service is provided "as is." We make no warranties, express or implied, about the accuracy, reliability, or completeness of AI-generated outputs.
We are not liable for: employment outcomes; decisions you make based on AI-generated content; inaccuracies in generated resumes, cover letters, or interview prep; loss of data due to browser storage clearing (for users without accounts); or any indirect, incidental, or consequential damages.
Maximum liability. Our total liability to you for any claims arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim.
This does not affect your statutory rights under EU consumer protection law, including the EU Consumer Rights Directive.
12. Termination
You may stop using the Service at any time by simply closing your browser (if no account) or deleting your account (if registered).
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Service in a way that harms other users or our infrastructure. We will provide notice where practicable.
Inactivity — retention schedule (effective 2026-06-15). If you do not sign in for an extended period, your account moves through the following stages. A single sign-in at any point resets the clock and restores everything.
- 0–8 months since last sign-in: account is active. No changes.
- At 8 months (240 days): first reminder email — "we miss you".
- At 9 months (270 days): second reminder — "your account will be archived in 30 days".
- At ~9.75 months (293 days): final warning — "7 days until archive".
- At 10 months (300 days): archive. Your drafts, cover letters, interview preps, and jobs are hidden from the app surface. We email you to confirm; signing in restores everything. No data is deleted yet.
- At 13 months (390 days): deletion-pending. Final email — "30 days until permanent deletion". You can still sign in to restore, or contact support.
- At 14 months (420 days): permanent deletion. Your account and all associated data are erased. Any remaining credits are forfeited.
One schedule for everyone, worldwide. This single 14-month window (420 days end-to-end) applies to all users regardless of location — EU, UK, United States (including California), and everywhere else. We deliberately apply the strictest jurisdiction's storage-limitation window to every account rather than varying it by where you live, in line with GDPR Article 5(1)(e) guidance from CNIL and the EDPB.
Manual deletion. You can delete your account at any time from /account → Danger Zone, which skips the warning sequence and goes straight to a 30-day deletion-pending window per GDPR Article 17 (right to erasure). Within those 30 days you can still cancel by signing in or contacting support.
Effect of termination. Upon account deletion — whether by you, by us, or due to inactivity — your personal data is permanently deleted within 30 days per our Privacy Policy. Unused credits are forfeited.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
Nothing in this section limits any non-waivable rights you may have as a consumer under your local law. If you are an EU consumer, you also have the right to submit disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
