AskTheRecruiter.com Affiliate Program — Terms & Conditions

By signing up as an affiliate ("Affiliate") for the AskTheRecruiter.com Affiliate Program (the "Program"), you agree to the following terms. AskTheRecruiter ("we", "us", "our") may modify these terms with 14 days' notice to active Affiliates via the email on file.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter binding agreements. The Program is open to individuals and registered businesses worldwide, subject to local laws.
2. Commission
We pay a one-time commission of 20% of the net purchase price (after discounts, taxes, and refunds) on each credit pack a referred customer purchases. Commission applies to all credit pack tiers and to every qualifying purchase made by the referred customer during the cookie attribution window or on subsequent visits while still attributed.
3. Attribution
We use a 30-day, first-click cookie attribution window. The first Affiliate to refer a customer (via their unique tracking link) is credited with all subsequent qualifying purchases for as long as the attribution holds, subject to our anti-fraud rules.
4. Payouts
Commissions are paid Net-30 in USD via the payout methods supported by our affiliate platform. Minimum payout balance is $25; balances below that roll over until the threshold is met. You are solely responsible for any taxes, fees, or government reporting obligations on commissions you receive, including completing any W-9, W-8, or equivalent forms where required.
5. Refund / Chargeback Clawback
If a referred customer requests a refund, files a chargeback, or disputes a charge, the corresponding commission will be reversed or deducted from your next payout. Commissions on purchases that are later voided or reversed for any reason are not payable.
6. Prohibited Activities
You may not:
(a) bid on AskTheRecruiter brand terms (including misspellings) in paid search advertising (Google Ads, Bing Ads, etc.); (b) use cookie stuffing, forced clicks, iframes, redirects, or any other technique that places a tracking cookie without an intentional user click; (c) spam, including unsolicited email, SMS, social DMs, forum spam, comment spam, or messaging that violates the recipient's platform TOS or applicable anti-spam laws (CAN-SPAM, CASL, GDPR ePrivacy); (d) misrepresent the product, fabricate testimonials, or make false claims about pricing, features, or guarantees; (e) use coupon, discount, or cashback sites without prior written approval; (f) self-refer (referring yourself, your immediate family, or any account you control); (g) use the Program in any manner that violates applicable law or third-party rights.
Violation of any of (a)–(g) results in forfeiture of pending commissions and immediate termination from the Program.
7. Brand Use
We grant you a limited, non-exclusive, revocable license to use our name and logo solely to promote AskTheRecruiter through the Program, consistent with any brand guidelines we publish. You may not modify our logo or imply partnership beyond the affiliate relationship.
8. Data Protection
We process personal data about Affiliates (name, email, payout method, tax information, IP address, conversion data) as a data controller under GDPR / UK GDPR / CCPA. Affiliates may exercise rights of access, rectification, deletion, portability, and objection per our Privacy Policy. We share Affiliate data with our affiliate platform (currently Endorsely, Inc.) as a processor under a DPA. Affiliates promoting the Program in the EU/UK must comply with applicable e-Privacy and cookie consent requirements when placing our tracking link on their own properties.
9. Confidentiality
Aggregate conversion statistics, our customer data, and any non-public information we share with you are confidential and may not be disclosed or used outside the Program.
10. Termination
Either party may terminate participation in the Program at any time with or without cause. Commissions earned through the termination date will be paid per Section 4, subject to Section 5 (clawback). We may withhold payouts for accounts under fraud investigation.
11. No Employment
Affiliates are independent contractors. Nothing in these terms creates employment, partnership, joint venture, or agency.
12. No Warranties; Limitation of Liability
The Program is provided "as is". To the maximum extent permitted by law, our aggregate liability under these terms is limited to the total commissions paid to you in the 12 months preceding the claim.
13. Governing Law
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Disputes will be resolved by binding arbitration in Wyoming under JAMS rules, except either party may seek injunctive relief in court.
